Terms of service

Draft for review by counsel before publication. These terms are an agreement between you (the practice or person using the Service) and Casaway Capital, LLC, doing business as August AI.

1. The Service

August provides an AI-operated marketing department for dental practices: a marketing director persona ("August"), a team of software agents, and tools for planning, creating, approving, and measuring marketing work. The Service acts on your instructions and within the approvals and limits you set.

2. Accounts and eligibility

You must be at least 18 and authorized to act for the practice you register. You are responsible for your credentials, for the people you invite, and for the roles you give them. Owners control Builder mode, spending limits, and connections.

3. Trials, plans, and billing

  • Every plan begins with a free 14-day trial. You will not be charged until the trial ends unless you choose a plan sooner.
  • Core is $299 per month and Growth is $599 per month per location, billed monthly in advance. Multi-location and DSO pricing is set by written agreement.
  • Advertising spend is paid by you directly to the advertising platforms and is not included in your subscription or marked up by August.
  • Plans include a monthly usage allowance; usage beyond it is billed as described in your plan details.
  • You may cancel at any time from the Service; cancellation takes effect at the end of the current billing period. Fees are not refundable except as required by law.

4. Approvals, spending limits, and your responsibility

Work that spends money, publishes publicly, changes your website, or contacts a patient requires your approval unless you have set an agent to act within limits you define. You set a monthly spending cap that no agent can exceed. You are responsible for reviewing and approving content, offers, and claims before they are published, and for their compliance with dental advertising rules and professional regulations in your state.

5. Your content and your ownership

You own the practice brain, campaigns, content, and results you create with the Service, and any website August builds for you, including its source code. You grant August the rights needed to operate the Service on your behalf. You may export your data at any time. August owns the Service, its agents, skills, and software; you receive a subscription to use them.

6. Connected accounts and third-party services

When you connect third-party accounts, you authorize August to act through them as you direct, subject to those services' terms. August is not responsible for third-party services, their availability, or their policies, including advertising platform reviews and restrictions.

7. Health information

August is HIPAA compliant. Marketing agents are designed not to receive patient records. Where the Service processes protected health information on your behalf, our Business Associate Agreement governs that processing and is incorporated into these terms.

8. Acceptable use

You will not use the Service to publish false or misleading claims, to contact people who have opted out, to violate any law or professional rule, to upload malicious code, or to interfere with the Service. Skills and agents you upload run only within your own workspace and remain subject to these terms.

9. AI outputs

The Service uses artificial intelligence to draft content and recommendations. Outputs can be wrong. You are responsible for reviewing outputs before relying on or publishing them. August does not provide legal, financial, or clinical advice.

10. Warranties and limitation of liability

The Service is provided "as is." To the fullest extent permitted by law, August disclaims all warranties and is not liable for indirect, incidental, or consequential damages, or for lost profits or revenue. August's total liability under these terms is limited to the fees you paid in the twelve months before the claim.

11. Termination

You may stop using the Service at any time. We may suspend or end access for violation of these terms. After termination you may export your data for 30 days, after which we may delete it.

12. General
